In Washington state, you’re automatically responsible for every thing you do, regardless of why you do it. Better have good video to fight it in court.
This is the main reason I got a dash cam. I don’t have collision insurance because repair wouldn’t be worth it but I definitely don’t want to be at fault for someone else’s mistake.
I always try to allow enough space between me and the car in front of me… so if they slam on their brakes, I can do the same thing. Many years ago when I was learning to drive, the instructor said, “If someone in front of you can stop on a dime, so can you.”
Without a dashcam, that would be extremely difficult to prove.
if the person in front of you brakes, you should be following at a safe enough distance to brake yourself rather than move over a lane.
you can (and should, in my opinion) move over a lane and pass them… IF IT’S CLEAR
Had an idiot hit the brakes to make a u-turn, right now. Car in front of me got stopped, I rear-ended them.
Insurance told me that if I had gotten that idiot’s information (at least a plate) they could have been found responsible for creating a hazard.
You rear end someone, it is 100% your fault (unless his brake lights were out) for not paying attention and following too close.

Happened really recently, so I’m not even sure yet
I mean…why were you tailgating? show up with that footage in court and tou’ll get an extra ticket.
